£70,000 plus costs awarded to Camden Employee for Disability Discrimination

In this case, I represented a former employee of Camden Council. Despite numerous attempts to settle the case, the Council persisted on defending all the way to the hearing.

A key point in this case was the Respondent’s approach to defending the case; it alleged that the Claimant was not disabled and insisted on a hearing on that topic despite having numerous reports confirming the serious nature of the condition.

This was an example of how disability related issues can form the basis of the case. Here the employee was unable to work for a while whilst treatment for her diabetes was corrected.

The case also illustrates the importance of not making assumptions about people with disabilities. The Employment Judge pointed out that doing this subverted the purpose of the disability legislation which is to help workers overcome conditions rather than being stereotyped.
