Employees with serious concerns about breaches of legal rights at work should try to resolve these informally where possible. Being over formal can be unhelpful to the ongoing working relationship but where this is necessary the ACAS Code (1) provides guidance to employers and employees on how to consider the issues fairly.

  • Narrowing the issues/what to investigate
  • Confidentiality
  • Are there any areas of agreement?
  • Practical solutions- training, counselling and prompt apologies are sometimes very powerful ways of diffusing legal situations.
  • Tactics

If an employee does not follow the ACAS Code (1) any award can be reduced by up to 25%. Employers who ignore the Code can face increased compensation awards of up to 25%.
