Suspensions must be handled carefully. Employers can make the mistaken assumption that a suspension is a ‘neutral act’ but the senior courts do not accept this. Suspensions can lead to employees being isolated or wrongly judged as ‘guilty’ by colleagues. The isolation which goes with suspension can cause stress. An employer who mishandles a suspension can face a constructive dismissal claim because it can easily amount to a serious breach of the implied term of trust and confidence.
