Victimisation

Victimisation takes place when an employee is subjected to any detriment or dismissal they have done a ‘protected act’ for example making a complaint about breaches of discriminatory legislation or whistleblowing.

Dates are very important as is supporting evidence. The main issues are:

  • When was the protected act?
  • What form did it take? – email, meeting, text or face- to- face
  • What was said? – how does this relate to discrimination or whistleblowing?
  • What dates did the detriments take place?
  • Can you prove that the detriments were because of the protected acts?
